CAT Protection, Revocation & Third-Country Removal
Protection under the Convention Against Torture (CAT) can prevent removal to a country where the applicable legal standard of torture risk is met. Deferral of removal and withholding under CAT are distinct forms of protection, and neither necessarily prevents removal to every country.
Protection under the Convention Against Torture
CAT withholding or deferral can protect against removal to a country where the person is more likely than not to be tortured with the required government involvement or acquiescence. Deferral has different termination procedures from withholding and asylum.
Termination and third-country removal
We assess notices, procedures for terminating protection, destination-country risk, and potential administrative or federal emergency remedies. A grant of CAT protection against one country does not necessarily prevent removal to every other country.
