Asylum Termination & Challenges to Protection
A grant of asylum does not eliminate every future immigration risk. DHS may seek to terminate asylum on specified statutory or regulatory grounds. The basis for the proposed termination, procedural posture, and available defenses matter.
When asylum may be terminated
The government may seek termination on specified statutory or regulatory grounds, including certain fraud, changed circumstances, or disqualifying conduct. Procedures differ depending on whether asylum was granted by USCIS or an immigration judge.
Defending protection
We review the original grant, current country evidence, asserted termination ground, notice and hearing rights, and potential alternative protection, including withholding and CAT.
